STANDARD TERMS & CONDITIONS

All dealings including all quotations /estimates and any other order placed following such quotation / estimate are subject to the following conditions of sale:

1.0 Validity of quotation

No order received from a Customer by A C Services Southern Ltd (hereafter A C Services) and no purported variation of these terms shall constitute a contract until accepted in writing by A C Services. The Company reserves the right to refuse any order, including subsequent to the sending of an order acknowledgement email.

2.0 Prices

Prices quoted by A C Services are current but we reserve the right to make adjustments if necessary due to currency fluctuations, raw material or factory increases. Unless otherwise stated, all prices are exclusive of any applicable value added tax, for which the customer shall be additionally liable to A C Services.

3.0 Payment

3.1 Payment must be received for the whole of the price of the goods you order, and any applicable charges for carriage and insurance, before your order can be accepted unless we have agreed otherwise in writing.

3.2 No payment shall be deemed to have been received, until A C Services has received cleared funds.

4.0 Delivery, Returns and Refunds

4.1 Delivery periods and dates are given in good faith, but are not the subject of any warranty or condition, and time shall not be of the essence of the contract in these respects. No liability will attach to A C Services if delivery periods or dates are not met for any reason whatsoever. Please advise us of any non-delivery within 5 days and confirm in writing.

4.2 Should you have ordered incorrect items you must inform us in writing within 48 hours of receiving said items and should you be entitled to return them (excludes ‘special order’ items) this would be at your cost, we will charge a re-stocking fee of 10% excluding delivery cost which will stand and send out replacement goods by return, wherever possible – re-delivery will be at your cost.

4.3 If you receive incorrect items due to an error on A C Services’s behalf, we will arrange collection and replacement at our delivery / collection expense.

4.4 If you cancel an order before delivery or have ordered incorrect items and as per 4.2 notify us within 48 hours, you will receive a refund equal to 90% of the purchase price excluding the delivery charges, which are retained in full. Any other refunds are payable entirely at the discretion of AC Services Southern Ltd and only in exceptional circumstances.

5.0 Carriage

5.1 As Rational Cleaning Chemical and Tablets are classed as hazardous goods, being corrosive, and therefore subject to COSHH* they have to be delivered via ADR courier. These products are sent by ADR courier Monday to Friday and will take up to 3 working days to be delivered on site.

ORDER DEADLINES

ADR items ordered will generally be delivered on days as shown below.

Ordered Monday before 14.00 – Arrive Thursday between 07.30 and 18.00

Ordered Tuesday before 14.00   – Arrive Friday between 07.30 and 18.00

Ordered Wednesday before 14.00 – Arrive Monday between 07.30 and 18.00

Ordered Thursday before 14.00 – Arrive Tuesday between 07.30 and 18.00

Ordered Friday before 14.00 – Arrive Wednesday between 07.30 and 18.00

N.B: Weekend deliveries are not available.

5.2 Rinse tablets/care tablets are not hazardous goods, therefore when ordered on their own, these products are sent on a 24 hour delivery service. Items ordered before 12 noon will arrive between 08.00 and 17.00 on the following working day.

ORDER DEADLINES

Ordered Monday before 12.00  – Arrive Tuesday between 08.00 and 17.00

Ordered Tuesday before 12.00  – Arrive Wednesday between 08.00 and 17.00

Ordered Wednesday before 12.00 – Arrive Thursday between 08.00 and 17.00

Ordered Thursday before 12.00 – Arrive Friday between 08.00 and 17.00

Ordered Friday before 12.00 – Arrive Monday between 08.00 and 17.00

N.B: Weekend deliveries are not available.

5.3 AC Services (Southern) Ltd endeavour to ensure that items arrive in the time frames supplied, however we cannot be held responsible if goods are not delivered on days as indicated. We would always encourage you to stock up in advance to ensure that you do not run out of cleaning products completely and that your oven is therefore always cleaned as required.

6.0 Warranty

6.1 A C Services warrants that all goods supplied by it will correspond to their specification and will be free from defects in materials on date of delivery. A C Services’s obligation in the event of a breach of this warranty is limited to the replacement of any defective goods, which shall be returned to A C Services by the customer. This warranty is given in lieu of all other warranties or conditions expressed or implied (whether by statute or otherwise) and is subject to the following conditions:

6.2 Claims must be notified in writing to A C Services within two days from the date of delivery.

6.3 A C Services shall be under no liability if the defect or failure, in the reasonable opinion of A C Services, arises from wilful damage or misuse, negligence by the customer or any third party, or failure to follow A C Services’s instructions.

6.4 A C Services shall be under no liability if the goods have not been paid by the due date for payment.

6.5 Except in the case of death or personal injury caused by A C Services’s negligence, A C Services shall not be liable for any consequential loss or damage (whether for loss of profit or otherwise) or other claims for consequential compensation.

7.0 Risk

The risk in the goods shall pass to the customer on delivery to the customer or (if earlier) when possession of the goods is taken by a carrier for delivery to the customer.

8.0 Force majeure

A C Services shall not be liable to the customer, or deemed to be in breach of any contract with the customer, by reason of any delay in performing, or any failure to perform, any of its obligations in relation to the goods. If the delay or failure was due to force majeure or to any other cause beyond A C Services’s reasonable control.

9.0 Reservation of title

The goods sold under these Conditions shall remain the absolute property of A C Services and legal title in the goods shall remain vested in A C Services until payment in full of all amounts invoiced or due to A C Services in respect of the Goods.

10.0 Standard Voucher Terms

11.0 Applicable Law

These conditions shall be governed by and construed in accordance with English Law and the parties acknowledge the exclusive jurisdiction of the English Courts.
